Man threatened by police for passing out Ron Paul info

Apparently the anti-freedom forces are alive and well, while nothing has happened about Mitt Romney’s campaign impersonating police officers, it’s apparently quite a challenge to hand out Ron Paul information.
Even after clearing that it’s legal to pass out information in a public park, Joel Ferguson was threatened by police for passing out political information in Hammond recently.
The first time, the police claimed the park was private property, and he had no rights, so Joel went and contacted the city attorney, who said that it was public property.
Even after that Joel has been threatened by the police (and if you think some thug with a gun threatening you isn’t frightening, good for you), who have reportedly said “She’s not here, I am”.
It’s not just censorship and vilification by the so called “mainstream media” that is the problem, it’s the members of the fascist police state who want to stamp out all meaningful dissent.
If Ron Paul is silenced, the constitution in the United States will provide as much protection for individual liberty as did the Soviet Constitution and the Chinese Constitution.

Please, before you claim that there is some ordinance about passing out fliers, realize that the City Attorney had given Joel the go ahead. This is just police deciding that Ron Paul doesn’t have the right to be a candidate for president.

No. It’s about cops not knowing the scope of their authority and violating your rights. The cops can be sued for this. Because it was outside their duties/job discription. They are not immune from liability when they violate your constitutional rights and make false statements. You were not harming anyone. The cops made a legal determination, and last time I checked, they didn’t hold bar cards, which would translate into practicing law without a license. I wonder if you could throw in conspiring to throw an election too?

Stand up for your rights guaranteed under the Constitution!! I’m the son of a Chicago Police Detective of 25 years who was a decorated combat vet of WWII and a POW. My brother was a wounded and decorated combat vet of Vietnam. Believe me! They would be angry if any policeman chose to prevent you from exercising your rights. There are other cops and soldiers out there of a “constitutional mettle.” We are Americans, with inalienable rights that can not be taken away. And if the government threatens to take them away…then it’s time to drag out the Declaration of Independence. Please read it! It says you have a right and an obligation to change your government if it tramples on your rights. It is stated in very strong and plain language. This is the heritage of this nation and was won with tears and blood…do not give them up…fight for them and protect them.

Wow, I read your statements and thought, “wow!” The problem is that most cops do not give a rat’s ass about the constitution, probably not about the law too much either. Heck, most of the military officers would probably be a little hard pressed to produce a copy of the constitution. It is all about the power of the position. If you believe that America is a country of laws, not privilege, consider that Commander Ward Dean, MD, USN, a highly decorated veteran, is in jail for ‘violating’ a law that does not exist. I am all for constitutional rights, along with Ron Paul.
Why doesn’t someone go to the park with a video camera and tape the police officers. Then send the video to Ron or post the video on U-Tube, and other sources.
It worked for those kids who were skateboarding in the parking lot.

No place has an ordinance against passing out flyers. Maybe under certain rare and/or dangerous and/or annoying conditions, but that would be the extent of it. Any ordinance against passing out flyers would be superfluous and unsupportable.
Even when there is no law for something, when the agents of the state threaten you, it’s a challenge to stand up to them.
What are you going to do?
Videotape them…go to jail
Resist them …go to jail.

Take the complaint to the US ATTY office of your city/state.

It certainly does take nerve to peacefully assert that you will not go along with police misbehavior.
A great book on this subject is YOU AND THE POLICE! by Boston T. Party. First, know your rights. Joel Ferguson did his homework by contacting the city attorney. When you are confident about your rights, you are empowered to quietly stand your ground and state your position. People confronted by police usually want to end “the scene” as soon as possible. Your willingness to stand there with him for as long as it takes to get him to back off speaks volumes to law officers.
Next, don’t make it personal with the police officer. Don’t threaten or attack his ego. That’s when police abuses occur. Speak to him as if witnesses are watching and you want to show no provocation on your part. Be courteous and address him as “Officer”.
He may be bluffing. Just quietly state your position.
Choose youe battles carefully. Something really worthwhile may be worth the risk of being arrested, but a temporary strategic retreat to gather information and your wits is often a wise choice. Decide beforehand how far you are willing to peacefully push things. Police are part of a system and they dislike being shown to be wrong in court. A police office friend of mine confided to me once that the current wisdom in his county is…”Big case, Big problem…Little case, little problem…No case, no problem!” They may not want to go to court any more than you do.
“Rights” are only rights when we can assert them.
